Counter-Notification Procedure

  1. Identification of the Removed or Disabled Material: Please clearly identify the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled (provide the specific URL).

  3. The User’s Contact Information: Include the user’s full legal name, mailing address, and telephone number, and a statement that the user consents to the jurisdiction of the Federal District Court for the judicial district in which the user is located (or if the user’s address is outside of the United States, for any judicial district in which the service provider may be found), and that the user will accept service of process from the person who provided the notification under subsection (c)(1)(C) or an agent of such person.  

Upon Receipt of a Valid Counter-Notification

Once our designated Copyright Agent receives a valid counter-notification, we may, at our discretion, reinstate the removed or disabled material after a period of ten (10) to fourteen (14) business days, unless we first receive notice from the person who submitted the original DMCA notice that such person has filed a court action seeking a court order to restrain the alleged infringer from engaging in the infringing activity.

In appropriate circumstances, our policy is to terminate the accounts of users who are determined to be repeat copyright infringers.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing or that material or activity was removed or disabled by mistake or misidentification may be subject to liability for damages, including costs and attorneys’ fees.
